T-Mobile can continue with exclusive iPhone sales - court

(TP) T-Mobile Germany can continue to offer the Apple iPhone with a two years contract and SIM lock, according to the civil chamber of the state court in Hamburg. The court repealed its earlier injunction under which T-Mobile was forced to offer the iPhone without SIM lock without a two years contract on 12 November caused by the lawsuit that Vodafone Germany filed against the exclusivity of the contract between Apple and T-Mobile Germany. The court decided after the hearing held on 29 November, that a breach of the German cartel law is not committed by the exclusive sale agreement. Vodafone has one month to appeal the court decision at the higher state court in Hamburg. Vodafone Germany waits for the written verdict to decide if it will launch an appeal. T-Mobile will stop selling an unlocked version of the iPhone but said that after customers’ contracts expire, it will unlock their iPhone at no charge.
